Terms of sale.

These terms govern every order placed with The Keychain Company. Placing an order means you have read them and agree to them. Refund policy is section 07, privacy is section 11.

01  WHO WE ARE

The Keychain Company (“we”, “us”, “our”) is a custom keychain manufacturer located in Lexington, Kentucky, USA. You (“customer”, “you”) are the person or business placing an order through thekeychaincompany.com (the “Site”). If you order on behalf of a business, you confirm you have authority to bind that business to these terms.

02  THE PRODUCT

We produce 3D-printed keychains bearing artwork you supply, in the size and quantity you select on the Site. Products are made to order and are unique to you. Specifications shown on the Site (dimensions, material, hardware) are nominal. Manufacturing tolerances of up to ±1 mm in dimension and minor surface variation inherent to 3D printing are normal and do not constitute a defect.

03  ORDERS AND ACCEPTANCE

An order is placed when you complete payment through our checkout. Your order is an offer to purchase. We accept it when we begin reviewing your file for production, which usually happens within one business day. We may decline or cancel an order at any time before production begins, for any reason, including artwork we cannot print, artwork that infringes someone else’s rights, suspected fraud, or a pricing or availability error. If we cancel, we refund the full amount paid.

Quantities are 25 to 500 units per order in multiples of 25. Runs above 500 units are quoted separately by email and are governed by these terms unless a written quote says otherwise.

04  PRICING, PAYMENT, AND TAXES

Prices are in US dollars and are shown before checkout. The unit price depends on size and quantity tier; the total is unit price × quantity plus shipping. Shipping is $5.95 per order and free at 100 units or more. Payment is due in full at checkout and is processed by Stripe; we never see or store your card number. Prices may change at any time, but the price you paid at checkout is the price for that order.

Unless stated at checkout, prices exclude sales tax. Where we are required to collect tax, it is added at checkout. You are responsible for any tax we are not required to collect.

05  YOUR ARTWORK

By uploading a file you represent and warrant that you own it or hold every right needed to have it reproduced on merchandise, and that its use does not infringe any trademark, copyright, publicity, or other right of any person. You grant us a non-exclusive, royalty-free license to reproduce, modify for printability, store, and use the artwork solely to produce, fulfil, and support your order, and to photograph the finished product for our own portfolio and marketing unless you tell us in writing not to before the order ships.

You agree to defend, indemnify, and hold us harmless from any claim, loss, or expense (including reasonable attorney fees) arising from artwork you supply or from your breach of this section.

We may refuse any artwork at our sole discretion, including content that is unlawful, hateful, or that we are not comfortable producing. Refused orders are refunded in full.

06  FILE REVIEW, COLOR, AND DETAIL

We check every file before it prints. If your artwork needs a change to print cleanly (for example, detail finer than about 1.5 mm, thin lines, or very small text), we email you the change we propose before production. If we do not hear back within 5 business days we may proceed with the proposed change, cancel and refund the order, or hold it until we do; the choice is ours.

We match colors from the file you send as closely as our materials allow. 3D-printed filament cannot reproduce every screen or Pantone color exactly. A reasonable difference between the color on your screen and the finished product is not a defect. If a precise color matters, email us a sample or a Pantone reference before ordering.

07  RETURNS, REPRINTS, AND REFUNDS

Custom products are final sale. Because each order is made to your artwork and cannot be resold, we do not accept returns or give refunds for change of mind, ordering the wrong size or quantity, artwork errors in the file you supplied (spelling, layout, resolution, color choice), or dissatisfaction with a color that is within normal 3D-printing variance.

We fix our mistakes. If what you receive does not match the file you sent and the specifications you selected — wrong size, wrong quantity, missing hardware, print defects such as layer separation or missing sections, or damage in transit — tell us within 14 days of delivery at grayer.gullett@gmail.com with your order number and photos. We will, at our option, reprint the affected units at no charge or refund the affected portion of the order. We may ask you to return the defective units at our expense before or after the remedy.

Cancellations. You may cancel for a full refund any time before we begin production. Once production has started, the order cannot be cancelled. Email us as soon as possible; we will tell you whether production has begun.

Refund method. Refunds go back to the original payment method through Stripe and typically appear within 5–10 business days depending on your bank. Shipping charges are refunded only when the whole order is cancelled or reprinted.

Chargebacks. Please contact us before disputing a charge with your bank. A dispute filed without first giving us a chance to resolve the issue may be treated as a breach of these terms.

08  TURNAROUND AND SHIPPING

Our target is to ship within 5 to 7 business days after we accept your order and your artwork is approved for print. This is an estimate, not a guarantee. Delays caused by artwork revisions, carrier issues, weather, material shortages, or events outside our control do not entitle you to cancel or to a refund, though we will keep you informed by email.

We ship to addresses in the United States only. Title and risk of loss pass to you when we hand the package to the carrier; however, if a package is lost in transit or arrives damaged, tell us within 14 days of the expected delivery date and we will work with the carrier and, where appropriate, reprint or refund. Please double-check the shipping address at checkout; we are not responsible for packages sent to an address you entered incorrectly, and re-shipping is at your cost.

09  WARRANTY DISCLAIMER

Except as expressly stated in section 07, products are provided “as is”. To the fullest extent permitted by law we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Keychains are decorative and promotional items, not safety equipment, and are not intended for children under 3 years of age.

10  LIMITATION OF LIABILITY

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to an order or these terms is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or lost data, even if we were told they were possible. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the smallest amount the law allows.

11  PRIVACY

To fulfil an order we collect your name, business name, email address, shipping address, order details, and the artwork file you upload. Payment details are collected and processed by Stripe under Stripe’s privacy policy; we receive only a confirmation, the last four digits of the card, and the billing email. Our contact form collects the name, business, email, and message you enter.

We use this information to produce and ship your order, to email you about it, to answer your messages, and to keep business records. We do not sell or rent personal information. We share it only with service providers who help us run the Site and fulfil orders (payment processing by Stripe, hosting by Vercel, database and file storage by Supabase, and the shipping carrier), each bound to use it only for that purpose, and where the law requires.

Order records are kept for as long as needed for accounting and warranty purposes, generally 7 years. Artwork files are kept so that you can reorder; email us to have a file deleted. Our Site uses no advertising cookies. You may request a copy or deletion of your personal information by emailing grayer.gullett@gmail.com; we will respond within 30 days.

12  INTELLECTUAL PROPERTY

Everything on the Site other than your artwork — text, photographs, design, code, and the name The Keychain Company — belongs to us or our licensors and may not be copied or used without written permission. Artwork you supply remains yours.

13  GOVERNING LAW AND DISPUTES

These terms and every order are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules. Any dispute that we cannot resolve by email within 30 days will be brought exclusively in the state or federal courts located in Fayette County, Kentucky, and you consent to their jurisdiction. Either party may bring an eligible claim in small claims court instead. To the extent permitted by law, each party waives the right to a jury trial and to participate in a class action.

14  GENERAL

These terms are the entire agreement between you and us about an order and replace any prior discussion. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it. You may not assign an order without our consent. We may update these terms; the version posted at the time you place an order applies to that order. Notices to us should go to grayer.gullett@gmail.com; notices to you go to the email on your order.
